RE: Request for an Internal Review

Thank you for the email that you sent on 06 October 2009 requesting an Internal Review regarding delays in responding to your Freedom of Information Act (FOIA) request. Your Internal Review has been passed to me for investigation as I carry out Internal Reviews for Ministry of Justice related matters.

On 10 August 2009, you requested information regarding the Ministry of Justice's knowledge of and involvement in The National Archives proposal to phase out The Office of Public Sector Information and the OPSI brand.

The Freedom of Information Act states in Section 10(1) that requests must be replied promptly and in any event, not later than the twentieth working day following the date of receipt. Although we try to achieve that instruction, sometimes it is not possible to comply within the time frame .

I have reviewed your FOI request and conclude that, there have been unavoidable delays in responding to your request for information. These delays can be attributed to, in part, by searches to ascertain if this information is available and also, to the high degree of cross communication within the Ministry of Justice which unfortunately, is still ongoing and resulting in the delays that you are experiencing.

I apologise for these delays and hope that we will soon be in a position to respond to your request for information.
