(1) Information which is not exempt information by virtue of section 30 is exempt
information if its disclosure under this Act would, or would be likely to, prejudice -
(a) the prevention or detection of crime
(b) the apprehension or prosecution of offenders
(g) the exercise by any public authority of its functions for any of the purposes
specified in subsection (2)
(2) The purposes referred to in subsection (1) (g) to (i) are -
(a) the purpose of ascertaining whether any person has failed to comply with the
(c) the purpose of ascertaining whether circumstances which would justify
regulatory action in pursuance of any enactment exist or may arise

The public are made aware of how VOSA deploys its resources in relation to the operational activities it undertakes.

The information requested is detailed enough that release is likely to result in conclusions being drawn on operational resourcing and targeting patterns employed by VOSA. Non compliant operators/drivers could use this information to avoid VOSA operations. This would be likely to result in an adverse impact on VOSA's operational capability and would be likely to prejudice the exercise of VOSA's functions in ascertaining whether operators/drivers have failed to comply with the law and in ascertaining whether circumstances which would justify regulatory action in pursuance of any enactment exist or may arise.
Releasing this information would prejudice VOSA in the prevention or detection of crime and the apprehension or prosecution of offenders.

Reasons why public interest favours withholding information
It is in the public interest that the regulatory activities undertaken by VOSA are not prejudiced as this would be detrimental to road safety.
It is in the public interest that non compliant operators/drivers and those with a high safety risk are not able to use data to minimise detection by VOSA as this would result in continuing non compliance/risk and could potentially jeopardise the safety of members of the public , e.g. the risk of serious road traffic accidents is increased.
