Re: Request under the 2000 Freedom of Information Act

Thank you for your e-mail of the 17th December 2009 in which you sought information held in connection with the Employment Tribunal under the Freedom of Information Act 2000 (FOIA).

In your request you asked for information relating to the following two points:

1. How many judgements have been awarded against employers when

there has been no evidence to show that the employer was the

appellants employer?

2. Please list the cases showing date, appellant, respondent, place

and Employment Judge or Tribunal Chairman.

Section 12(2) of the Freedom of Information Act 2000 (FOIA) exempts a public authority from the duty to confirm or deny if they hold the information being requested if they estimate that to confirm or deny would exceed the appropriate limit.

The appropriate limit for central Government is set at £600, which represents one person spending 3.5 working days in locating, extracting and collating the information being requested.

In this instance you may wish to refine your request, for example it might assist if you were to specify a time frame in points (1.) and (2.) of your request.

As part of our obligations under the FOIA, the Ministry of Justice has an independent review process. If you are dissatisfied with this decision you may write to request an internal review. The internal review will be carried out by someone who did not make the original decision and they will re-assess how the Department handled the original request.
