Freedom of Information (FOI) Act 2000: Request for information

Thank you for your request for information that was logged on 23 July 2009 relating to FOI/4121, You have requested the following information:

  1. Could I please ask the total number of Council provided motorcycle parking spaces available annually from 2004 until the present within Westminster?

  2. Could I ask the reason for the difference over each year?

  3. Could I also ask for the details and dates of any legislation brought in by Westminster to disallow motorcycles to park on pavements and common ground?

  4. Lastly, could I ask for the most recent details for PCN's given to cars, motorcycles and other forms of transport from January 2009?

In response to your request I can advise you of the following:

  1. The current number of motorcycle bays in Westminster can be found on the City Council's website via the following web link:

The Traffic Management Order (TMO) records dating back to 2004 are held in manual form. Therefore, in order for the City Council to provide the information you require, these records would have to be checked manually.

I am considering your request; however, it is estimated that in accomplishing this task, it would take an assigned officer a total of 30 hours. As a result, a fee in the sum of £750 would be required in order for the data to be extracted collated and provided.

This amount exceeds the “appropriate limit” of £450 as stated in the FOI (Fees & Appropriate Limit 2002) Regulations 2004 as set out in Section 12 of the FOI Act 2008.

If you wish to proceed with your request, please send your fee to Parking Services at the enclosed address. You have 3 months in which to pay this amount.

However, please note that details of any current TMO may be viewed by a member of the public at the offices of the City Councils consultants West One. Their address is as follows:

  1. The allocation of additional space, for Motorcycle Parking can be provide for a number of different reasons. For example requests can come from the public, requesting the increase or decrease of on-street provision. The City Council would then consider any such request in accordance with the legislative Traffic Management process.

  1. The legislation regarding motorcycles parking on pavements and common ground dropped footway enforcement, was brought in by Westminster Council on February 2nd 2009.

The enforcement of dropped footways is governed by, the provisions of Section 14 of the London Local Authorities and Transport for London Act 2003, and also Section 86 of the Traffic Management Act 2004, which can be found via the following website http://www.opsi.gov.uk.

All PCN's given from January 2009 to all vehicles has been added as an attachment to this email.
