Dear Sirs,

Thank you for your e-mail dated 26 July 2008 asking for information about the granting/refusal of indefinite leave to enter/remain under the Case Resolution Exercise. You have asked for the factors that may lead to the granting or refusal of ILE/R and the maximum time required for a case worker to bring a case to conclusion, from the time the asylum seeker submits the questionnaire. Your request has been dealt with as a request for information under the Freedom of Information Act 2000.

In response to your request for the factors that may lead to the granting or refusal of ILE/R, details of UK Border Agency policy guidance and instructions and immigration law can be found at: www.ukba.homeoffice.gov.uk/policyandlaw/.

You have also asked what the maximum amount of time required for a caseworker to bring a case to conclusion, from the time an asylum seeker submits a questionnaire. Each case is dealt with on its individual merits in line with our published priorities, which can be found at: http://ukba.homeoffice.gov.uk/asylum/process/oldercases/140639/, therefore no maximum processing time is available. However, we remain on track to complete all cases by summer 2011.

If you are dissatisfied with this response you may request an independent internal review of our handling of your request. Internal review requests should be submitted within two months of the UK Border Agency sending a substantive reply to your original request and should be addressed to:
