Dear Mr McGillivray,
Request under the Environmental Information (Scotland) Regulations 2004
I refer to your request dated 3 July 2009 requesting that certain information be provided to you. The
Council is treating your request as a request under the Environmental Information (Scotland)
Regulations 2004 rather than the Freedom of Information Act.
Our records do not indicate what type of telecommunication mast is applied for and therefore, it
would appear that Glasgow City Council does not hold the information which you have requested.
Accordingly we are unable to comply with your request.
In lieu of this information I have been able to provide a list of all telecommunication mast
applications which have been applied for during the specified period and this may be able to provide
some of the information you require.
I have searched the Planning records and have attached a list of all valid telecommunication
applications received between 1st January 1998 and 30th June 2009. The list includes most of the
details you requested ie current status of the application, date of decision and locations which are
given by address and by map reference. In addition details have been provided of when any
decision was appealed to the Scottish Ministers and the outcome of that appeal. Not all applications
have been determined and, as an applicant currently has 6 months to make an appeal, some of the
applications shown may still be within their appeal period.
The applicant is not required to notify the Council of whether they actually implement any consent
granted and so I am unable to provide information as to whether, or on what date, any mast was
installed. I understand, however, that Ofcom host a website at www.sitefinder.ofcom.org.uk which
shows the location of masts throughout Britain which may be of some assistance.
Please note that the information provided in response to your request is, unless otherwise indicated,
copyright © Glasgow City Council 2005. It is supplied to you in terms of the Environmental
Information (Scotland) Regulations 2004. Any further use by you of this information must comply
with the terms of the Copyright, Designs and Patents Act 1988 as amended and/or the Copyright
and Rights in Databases Regulations 1997. In particular, any commercial use or re-use of the
information provided requires the prior written consent of the Council. Requests for such consent
should be addressed to the Head of Corporate Communications, Glasgow City Council, City
Chambers, George Square, Glasgow G2 1DU.
Some or all of the information may be subject to third party copyright, in which case the permission
of the third party copyright holder may be required. No claim is made in respect of third party
copyright.

different purpose may therefore contravene the provisions of the Data Protection Act 1998.
If you are dissatisfied with the way Glasgow City Council has dealt with your request you are entitled
to require the Council to review its decision. Please note that for a review to take place you must:
• Lodge a written requirement for a review within 40 working days of the date of this letter
• Include a correspondence address and a description of the original request and the reason why
you are dissatisfied

You will receive notice of the results of the review within 20 working days of receipt of your request.
The notice will state the decision reached by the reviewing officer as well as details of how to appeal
to the Scottish Information Commissioner if you are still dissatisfied with the Council’s response.
You must request an internal review by the Council before a complaint can be directed to the
Scottish Information Commissioner.
If you have any further queries regarding this process, please do not hesitate to contact me.
Yours sincerely,
Alistair MacDonald
