Dear Mr Main,

Thank you for your e-mail of 24/06/2009 8:41:59 PM about Phorm in which you suggest the Information Commissioner's Office is the only body with responsibility for Phorm. This suggestion is not correct and therefore there is no material that I can disclose to you that supports your suggestion.

The Information Commissioners Office (ICO) has responsibility for data protection matters and in that capacity the ICO has had discussion with Phorm.

The Regulation of Investigatory Powers Act 2000 (RIPA) is the responsibility of the Home Office. However, it remains the responsibility of the Police to investigate any breach of the interception provisions of RIPA by an individual or private sector company.
