Dear Mr Nunn

Request for information

In your email of 23 July, you asked:

  1. Out of the cases still on record which one has remained undetermined for the longest period of time?

  2. What was the reason for the delay?

  3. What was the subject of the complaint?

  4. Which Ombudsman/Ombudsmen were involved?

Following my request for you to clarify what you meant by `undetermined' you said: “I seek to identify, from the records you still have, what is the longest period of time a complainant has ever had to wait for a Local Government Ombudsman to make a decision regarding their case?”

My answers are:

  1. Of the cases that are still on our database, the one that has taken the longest to reach a decision was a case received in August 1992, on which no decision was taken until March 1998. In all, the case was open for 2,036 days.

  2. The file has long since been destroyed, so the reason for the delay is no longer on record.

  3. The complaint was about Managing Tenancies.

  4. The complaint was handled by the London office, and for most of the period concerned the Ombudsman was Sir Edward Osmotherly. Before 1993, the Ombudsman was Sir David Yardley.

That concludes my response and I hope you find the information useful. If you feel I have not dealt properly with your request, you have the right to appeal and, should you wish to do so, I can supply a copy our internal complaints procedure. You also have the right to apply to the Information Commissioner to determine whether your request has been properly dealt with. You should note however that the Commissioner will not consider any complaint where you have not first exhausted our internal complaints process or where there has been undue delay in contacting him. You will be able to obtain further details of the Information Commissioner's role from the website on www.ico.gov.uk.

Yours sincerely
