REVIEW OF A REQUEST UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002
(THE “ACT”)
I refer to your email of 18 June 2009 containing an FOI request and to your review request dated 17 July 2009.
I understand you did not receive a response to your request for information within the timescale set out in the Act. However, I further understand that a response to your request for information was sent to you on behalf of the Executive Director of Land and Environmental Services by email on 17 August 2009.
I have now conducted a review of this matter, addressing the issue of the delay in dealing with your request.
On behalf of the Council I apologise for the delay in responding to your request. You should have received a response to your request within the twenty working day time frame set down in the legislation and I apologise that you did not.
I have carried out an investigation to ascertain the reasons for the delay in responding to you. It transpires that due to an administrative error your response was not dealt with in accordance with the Act.
I trust the response sent on behalf of the Executive Director of Land and Environmental Services on 17 August 2009 will answer your request for information. However if you are not satisfied with the response you receive you can request a review of said response.
If you are not satisfied with the response to your review request that you have received in this letter you have the right to make an application within six months of receipt of this letter for a decision by the Scottish Information Commissioner, Kinburn Castle, Doubledykes Road, St Andrews KY16 9DS.
