Freedom of Information Act (FOIA) 2000

Acknowledgement

Thank you for your application received by us on 05 June 2009 requesting the following:

1. Does your Local Authority presently employ Education
Counsellors* (rather than `buying in' such a service from an
external provider)?

2. If the answer to Question 1 is `yes', please state for each
Education Counsellor employed by the Local Authority:

• Whether they have been deemed to be eligible to join the Teachers
Pension Scheme and

• The date when they joined the Teachers Pension Scheme

• Whether they are employed on Teachers Terms and Conditions of
Employment

3. If your Local Authority does not presently employ Education
Counsellors have they done so in the past?

4. If the answer to Question 3 is `yes', please state for each
School Counsellor employed by the Local Authority since 31 March
2004:

• Whether they were deemed to be eligible to join the Teachers
Pension Scheme and

• When they joined the Teachers Pension Scheme

* Education Counsellors meaning those employed to support pupils in
education

Your definition of Education Counsellors as “those employed to support pupils in
education”, could cover a range of posts so it would be helpful if you could explain the range of support that you deem applicable for the purposes of this enquiry. We have no employees designated as Education Counsellors. Schools have a range o
f posts offering a range of support. In order to judge whether any of these posts are applicable it will be necessary to have a more precise definition.

Your application will be held in abeyance pending clarification. Please email the information to [email address].

Once received your request will be assessed under the Act and the information provided to you within the statutory time limit of twenty working days following receipt of the additional information.

However, if this information is subject to an exemption defined by the Act which prevents us from releasing it, we will issue you with a Refusal Notice together with your rights of Appeal.

There are circumstances where a fee may be payable to cover administration costs (e.g. printing, copying, postage and packaging) and if so, we will issue you with a `Fees Notice' requesting payment. In this event, the fee must be paid before the information requested is processed and released and the statutory time limit will be suspended until payment is received.

In the meantime, if you have any queries please do not hesitate to contact us, quoting the above reference number.
