Notice of Order under section 13 of the Criminal Justice and Police Act 2001
in Brent borough wide
On 29 October 2007, a full Council meeting of Brent Council decided to make an Order under section 13 of the
Criminal Justice and Police Act 2001 (“the 2001 Act”) in respect of the whole of the Borough of Brent. This is known
as a designated public place order. This Order will come to effect on 15 December 2007. When the Order comes into
effect, it will mean that if a police constable reasonably believes that a person is, or has been, consuming intoxicating
liquor within the controlled area the constable may require the person concerned:
(a) not to consume in that place anything which is, or which the constable reasonably believes to be
intoxicating liquor
(b) to surrender anything in his/her possession which is, or which the constable reasonably believes to be
intoxicating liquor or a container for such liquor (other than a sealed container).
A constable may dispose of anything surrendered to him/her as above. The proposed order will only have effect in
public places. It will not apply to the following categories of premises:
(i) premises with a premises licence which authorises the premises to be used for the sale or supply of alcohol (e.g.
pubs, supermarkets, off-licences)
(ii) premises where the Council holds the premises licence, which authorises the sale or supply of alcohol, or
occupies or has managed on its behalf a premises subject to a premises licence authorising the sale or supply of
alcohol, at times when alcohol is being sold or supplied and within 30 minutes thereafter;
(iii) premises with a club premises certificate which certifies that the premises may be used by the club for the sale of
supply of alcohol;
(iv) places that are within the curtilage of premises with a premises licence or club premises certificate;
(v) premises that are the subject of a Temporary Event Notice at times when alcohol is being sold or supplied and
within 30 minutes thereafter;
(vi) premises permitted for the sale of or consumption of alcohol under section 115E of the Highways Act 1980.
Premises in which there is currently in force a premises licence authorising the sale or supply of alcohol, and where
either the premises licence is held by the Council or the premises licence is held by another person but the premises
are occupied by a local authority or managed or behalf of a local authority within the London Borough of Brent, are
set out below:
(i) Brent Town Hall, Forty Lane, Wembley, Middlesex HA9 9HD
(ii) Brent Town Hall Annexe, Forty Lane, Middlesex HA9 9HD
(iii) Bridge Park Community Leisure Centre, Brentfield, Harrow Road, London NW10 0RG
(iv) Willesden Green Library Centre, 95 High Road, Willesden, London NW10 2SF
A person who fails without reasonable excuse to comply with a requirement imposed upon him/her as above will
commit an offence and will be liable to a fixed penalty or a fine to the maximum of level 2 (currently £50 and £500
respectively). This Order will become effective from 15 December 2007.
