RE: Freedom of Information Request 63442
I refer to your request under the Freedom of Information Act 2000 dated 05 June 2009 in which you requested a copy of the decision and report (L/6) regarding The Neptune Theatre.

The Board considered whether -
(i) members of the press and public should be excluded from the meeting of the Board during consideration of the following items of business in accordance with sub-section 4 of section 100A of the Local Government Act 1972 because it is likely in view of the nature of the business that exempt information would be disclosed being information defined in section 100(1) and paragraph 3 (information relating to the financial or business affairs of any particular person (including the authority holding the information)) of Schedule 12A of the Local Government Act 1972; and
(ii) the disclosure of information is in the Public Interest, if any relevant exemptions are applicable and whether, when applying the Public Interest test and exemptions, the Public Interest to disclose outweighs that of withholding information.
Resolved that as in all the circumstances of the case the public interest in maintaining the exemption outweighs the public interest in disclosing the information therefore members of the press and public be excluded from the meeting of the Board during consideration of the following items of business in accordance with sub-section 4 of section 100A of the Local Government Act 1972 because it is likely in view of the nature of the business that exempt information would be disclosed being information defined in section 100(1) and paragraph 3 (information relating to the financial or business affairs of any particular person (including the authority holding the information)) of Schedule 12A of the Local Government Act 1972.
