Dear Mr Nunn

Request for information

In your email of 3 June, you asked for information supplied by us to the DCLG which led to them making the statement that compliance with Ombudsmen's reports in 2006/07 and 2007/08 was 100%.

The difficulty with making statements about compliance with Ombudsmen's reports is that the results will differ depending on whether the statement refers to compliance with:

  1. reports issued in a certain period;

  2. further reports issued in a certain period; or

  3. what Statements on non-compliance were published in a certain period.

I attach a document supplied to the DCLG last May. This shows that:

  1. for reports issued 2006/07, there was one case (Trafford 04/C/17057) where a Statement was issued (ie the case was unsatisfied); there were no cases of non-compliance on 2007/08 reports;

  2. for further reports issued in 2006/07, there was one case (East Riding of Yorkshire 04/C/7641) of non-compliance; for further reports issued in 2007/08 there was one case (the Trafford case noted above) of non-compliance;

  3. the two Statements noted above were both issued in 2007/08, so if looking at compliance in terms of when the Statements were published there would be none in 2006/07 and two in 2007/08.
