Dear Mr Batsworth
REQUEST FOR INFORMATION
We refer to your request for information under the Freedom of Information Act
(FOIA) dated 3 June 2009 and our initial response letter dated 1 July 2009.
Following our initial response, we were continuing to review the information
requested in item 4 of your request which is set out below for ease of
reference.
A copy of the log of all calls taken to date. Personal information eg.
contact details of the caller can be excluded; I am interested in the
dates/times, subject of call and response provided if available.
We confirmed that we held information relevant to this request and that we
were still in the process of reviewing the information and extracting the
relevant personal data (as set out in Section 40 of the FOIA and for the
reasons explained in our initial request) from the information before we can
provide this information to you.
The Olympic Delivery Authority is a statutory authority established under the London Olympic Games and Paralympic
1
Games Act 2006.

This review process has been far more time intensive than we had initially
expected and as such, we are still in the process of completing the review of
the calls from January to the end of May 2009. You will appreciate that as the
Construction Hotline is confidential, we are required to take great care to
ensure the anonymity of the callers and ensure that their privacy and Data
Protection rights are protected. This careful scrutiny has resulted in the review
of this information taking longer than we had anticipated. We hope to be in a
position to provide the requested information for the period 1 January up to 31
May 2009 by the end of next week. Once again, we apologise for the delay,
but trust that you will understand the ODA’s concern to ensure the
confidentiality of the callers on the Construction Hotline.
We have also now, unwittingly, exceeded the time cost allowance in relation to
this request. We had not appreciated how long it would take to review the
relevant information in the call logs. In order to assist you understand how the
ODA has spent its time in relation to this request, we have provided an
approximated breakdown of the time and cost spend on your request:
1.  Locating the information or documents containing the information: £75
(about 3 hours at £25.00 per hour).
2.  Retrieving such information or documents: £125 (about 5 hours at
£25.00 per hour).
3.  Extracting the information from the documents containing it (including
editing):  £325 (about 13 hours at £25.00 per hour).
Total cost: £525 (about 21 hours at £25.00 per hour).
Under Section 12(1) of the FOIA and Regulations 3 and 4 of the Fee
Regulations, the appropriate fee limit for the ODA is set at £450.00. This limit
is calculated on the basis of 18 hours’ work at £25 per hour. Since the cost of
complying with your request exceeds the appropriate cost limit, we are
refusing that to provide you with the Item 4 information which you have
requested for the period from the inception of the Construction Hotline up to
31 December 2008.
We will continue to finalise the review of the 2009 Construction Hotline call
data and will respond to you as soon as this is complete at the end of next
week.

Yours sincerely
