Dear Ms Speers,

I am writing in response to your request for an internal review of your recent request for information. The request was processed under the provisions of the Freedom of Information Act 2000 (FOIA). In your e-mail of 2ⁿ^d June 2009, you requested the following information:

1) How has the Mental Health Act Commission's remit changed since becoming part of the Care Quality Commission?

2) Is the protection of the interests of detained patients still the main part of the MHAC remit?

3) How will the MHAC know when a patient is detained?

Having now had the opportunity to consider your request and the response you received from Mr. Andrew Lall, I remain of the view that the Commission provided the requested information and responded to the request in accordance with the provisions of the FOIA and in line with good practice guidelines.

Mr Lall responded to your request on the 3^rd June 2009, this is one day after the request was made and therefore well within the 20 working day statutory timescale. In addition, Mr Lall provided you with the requested information by providing you with the breakdown of the new statutory remit under Section 120 of the Health and Social Care Act 2008. In addition you were provided with an explanation in relation to question1 and answers to your questions numbers 2 and 3 above.

Having considered the above, I am unable to identify exactly what your concerns are regarding Mr Lall's response to your request and therefore I consider that Mr Lall's response to you was appropriate. If you would like to provide further details of the concerns which you have in relation to our response to this request, I would be happy to review them further.
