Volume 2 - Draft Output Specification

OUTPUT SPECIFICATION FOR THE DELIVERY OF AN ON-STREET VEHICLE NETWORK IN WESTMINSTER

  1. Introduction

    1. The words and expressions used in this Output Specification shall have the meanings set out in Clause 1 (Definitions and Interpretation) to the Contract.

    1. This Output Specification defines the City Council's minimum requirements for the Scheme. The Contractor must provide the Scheme in accordance with all of the requirements and to the standards set out in this Output Specification. This Output Specification will form Schedule 1 (Specification) to the Contract.

1.3 The fundamental overall objectives for the Scheme are to:

    1. The City Council's long term aspirations are to encourage a step change in driver behaviour in the City of Westminster and by 2020 to have:

    1. The Scheme is to be open to members of the public and its purpose is to allow Members on payment of a fee to book, hire or rent, and use Vehicles which are parked in Bays within the City of Westminster.

2. scope of the scheme

Bays

    1. The Contractor shall provide the Vehicles in the Bays at the Locations.

    1. The provision of Bays will be managed via an experimental traffic management order (`ETO') process which enables Bays to be located `on-street'. The City Council shall undertake the order making and notification process. During the first 18 months of the Contract the City Council shall use the ETO to implement the use of the Bays for the Scheme. Following a minimum of 6 months' continuous operation and before the end of the experimental period, the City Council shall review all correspondence received during the trial period and determine whether the provisions of the ETO will remain in force indefinitely. If approved, the City Council shall then make a permanent traffic management order (`TMO') for the Bays. Any changes to Bays managed under the ETO or future Bays will be subject to TMO process and the City Council shall undertake this process.

    1. Future Bays will be identified, and subject to TMO process used to supply Vehicles, through the following mechanisms:

      1. Locations that are identified by the City Council unless the Contractor can demonstrate to the City Council that the Location is not commercially viable; and

      1. Locations that are nominated by the Contractor and approved by the City Council.

    1. If the Contractor for any reason requests the location of any Bay introduced under an ETO or TMO to be changed the Contractor shall not be entitled to a refund of the price paid by the Contractor to the City Council for that Bay from the City Council and the Contractor shall be liable to pay to the City Council the price for any replacement Bay.

Equipment

    1. The Contractor shall provide all equipment and materials (other than signage) necessary for the provision of the Scheme.

Permits

    1. The Contractor shall provide the Scheme in accordance with the scheme for Permits.

Signage

    1. The City Council has approval from the Department for Transport for the signs to be used for the Scheme, and shall working in collaboration with the Contractor, who shall input in to the content of the signs, finalise the remaining content of the signs, and provide the infrastructure (posts and lines) for the signs to be installed by the City Council on the street.

Vehicles

    1. The Contractor shall lease or own all Vehicles.

    1. The Contractor shall ensure that an appropriate selection of Vehicles is made available across the City of Westminster including but without limitation:

    1. The Contractor shall ensure that supplier logos on Vehicles are unobtrusive where possible.

Vehicle Maintenance

    1. The Contractor shall ensure that they have systems in place for maintenance of their Vehicles. This includes but is not limited to ensuring that

Carplus accreditation

    1. The Contractor shall at all times have and maintain Carplus Accreditation.

Scheme hours

    1. The Contractor shall provide the Scheme 24 hours per day, 7 days per week, 52 weeks per year.

3. Enforcement & Penalty Charge Notices (`PCNs')

    1. The City Council is responsible for all enforcement activities in line with its responsibilities for on-street parking. The Contractor shall manage parking contraventions and police action, including but not limited to the following:

4. Operation of the Scheme to Members

Registration

    1. The Contractor shall provide online capabilities and a national or local low rate telephone number for people who want to register with the Contractor for the Scheme and for contacting the Contractor's office.

    1. The Contractor shall transfer ownership of the national or local low rate telephone number referred to in paragraph 4.1 above to the City Council or a new contractor at the end of the Contract Period at no cost to the City Council or a new contractor save for any charges made by the telecommunications operator.

    1. Once a person is registered as a Member, the Contractor shall permit that Member to use any of the Contractor's other vehicle network/car club services available in the United Kingdom and throughout the world.

    1. The Contractor shall supply Members with details of how they can manage their account with the Contractor via the City Council's website or a City Council website hosted by the Contractor.

    1. The Contractor shall, where possible, give Members the opportunity to decline receiving paper copies of Scheme literature when receiving Membership information.

Booking and access technology

    1. The Contractor shall arrange for Members to be able to book a Vehicle via a wide range of means including but not limited to telephone, internet and from within a Vehicle.

Indemnity Insurance for Members

    1. The Contractor shall make available indemnity insurance for Members which may include without limitation

Pick up and return

4.8 The Contractor shall require Members to collect a Vehicle from a specified Bay and to return it to a specified Bay.

Data Protection Act 1998

4.9 The Contractor shall obtain a Member's written consent to the passing of any of their personal data to the City Council and/or any new contractor operating the City Council's vehicle network scheme on registration of that Member under the Scheme.

5. Back Office operations

    1. All back office and administrative requirements associated with the operation of the Scheme shall be managed by the Contractor.

6. Technical Support Requirements

Support

    1. The Contractor shall provide full technical support for the operation of the Scheme, including how to report faults, target service levels for resolution, allow the Authorised Officer to make enquiries on specific data, and provide access to their development plans for software upgrades and developments on a regular basis.

Security

    1. The Contractor shall ensure that at all times during the Contract Period adequate security systems are in place for IT and manual systems, including but not limited to:

Disaster Recovery & Business Continuity

    1. The Contractor shall ensure that at all times during the Contract Period adequate disaster recovery and business continuity arrangements are in place for the event of the partial or total failure of the Contractor's computer system which arrangements shall enable the Contractor to continue without interruption to provide the Scheme to Members.

7. Changes to Scheme

    1. The Contractor shall obtain the City Council's written approval of any changes to the Scheme including, without limitation, on rates, Vehicles, and terms and conditions for Members at least 30 days before they are implemented. In the event of any dispute in relation to such changes, the dispute shall be referred to the Dispute Resolution Procedure and if necessary the Expert.

8. Marketing and Branding

8.1The City Council and the Contractor shall work together to advertise the Scheme.

    1. The Contractor shall make promotional material, including without limitation, leaflets, brochures, promotional events, articles in local magazines, newspapers and online publications available to Members and prospective Members. All promotional material shall be clearly distinctive and co-branded with the City Council, and agreed by the City Council, subject to the City Council's policies on advertising/marketing.

    1. The Contractor shall ensure that all promotional material is from sustainable or recyclable material.

    1. The Contractor shall give Members the opportunity to opt out of receiving paper copies of promotional material.

9. Customer Care

    1. The Contractor shall have customer care policies in place to ensure high customer satisfaction, and in particular, but without limitation the following:-

    1. The Contractor shall provide the City Council with operational information at the City Council's request and frequency including without limitation the following:

The above list is not exhaustive and the Contractor may be required to provide any additional ad hoc information at the City Council's request or that the City Council considers is relevant to the provision of or future development (including innovation) of the Scheme.

    1. The Contractor shall ensure the availability and process for raw data related to monitoring information for City Council staff to process.

    1. The Contractor shall, if required by the City Council, make operational information available for automated transfer to the City Council's network to allow for integration into the City Council's corporate information reporting system.
