FREEDOM OF INFORMATION ACT REQUEST NO 405/2009-1439
I am making a request for information under the terms of the Freedom of Information Act.
It concerns age discrimination.
Could you please tell me if Devon and Cornwall Constabulary has a policy statement regarding employment of civilian personnel that addresses the issue of the age of applicants? If you have such a policy document, then I would like a copy of it. It can be provided in any standard digital format.
I would also like to know if you have an upper age limit beyond which you will not consider employing any person.
I would also like to know if you have a normal retirement age for civilian employees.
I would also like to know if the person making the decision on who to shortlist for interview or who to hire is able to see information revealing the age or date of birth of the applicant.
I would also like to know how many civilian employees you have who are aged over 65.

Clause 9.2 - Under the Employment Equality (Age) Regulations 7(4) the Force can lawfully discriminate by not offering employment to a person who, at the time of their application, is over the Force's normal retirement age of 65 or will reach the age of 65 within six months of their application
I would also like to know if you have a normal retirement age for civilian employees.
The force's default retirement age for police staff is 65. This concurs with the default age set by the Employment Equality (Age) Regulations 2006.

Applicants complete an Equal Opportunities Form, which contains personal details - this is not used as part of the selection process. Applicants are judged based on skills, qualifications etc. against the role profile for the job in question. The central part of the Application Form is removed and forwarded to those short listing - with personal information removed and a reference number inserted. In the event CV's are used instead of Application Forms, there may be occasions when a short lister could view personal details, however many CV's do not contain this information.
I would also like to know how many civilian employees you have who are aged over 65.
We currently have 11 police staff members over the age of 65.
