Re: Request under the 2000 Freedom of Information Act
Thank you for your e-mail dated 11th May 2009, in which you sought information relating to the following from the Ministry of Justice.
A list of prisons broken down into security categories. The only list of prisons I have so far found is an alphabetical list with security category detailed, however I would like a list which breaks down prisons into their security category.
I can confirm that the Department holds the information you are seeking. You can find this information at the Department's website free of charge at the following internet address:
Unfortunately the information is not held in a list broken down into security categories. The FOIA provides the right of access to recorded information held by public authorities - in this case the public authority is the Ministry of Justice (MoJ). Recorded information is information which is held in permanent form. This includes electronic documents, physical files, microfiche, audio recordings, etc. However, the FOIA does not oblige a public authority to create information in order to respond to a request.
As the information you are seeking is already available in the public domain, it is exempt from disclosure under Section 21 (Information accessible to the applicant by other means) of the FOIA.
As part of our obligations under the FOIA, the Ministry of Justice has an independent review process. If you are dissatisfied with this decision, you may write to request an internal review. The internal review will be carried out by someone who did not make the original decision, and they will re-assess how the Department handled the original request.
