June 2009

Dear Mr Simpson,

Thank you for your request of 05 May, 2009, for the release of information under the Freedom of Information (Scotland) Act 2002, I have been asked to respond.

You asked that we provide you with:

1. All information held by the Scottish Executive on the first British Armed Forces Day (27 June 2009)

1.1 What is the Scottish Executive doing to promote Armed Forces Day

1.2 Any communication from the Ministry of Defence regarding Armed Forces Day

1.3 What guidance the Scottish Executive is giving to Scottish schools to celebrate this event

In response to points 1, 1.1 and 1.2, please find attached Annex A which contains details of all information held by the Scottish Executive on the First British Armed Forces Day; participation by Scottish Government Ministers for the promotion of Armed Forces Day; and, any communiqués between Scottish Executive officials and the MOD Armed Forces Day team.

In response to point 1.3 above, as the legislative responsibility for the provision of education rests with local authorities, Scottish Ministers have no locus in directing schools on whether or not to celebrate this event. It would be for each individual Education Authority to make a decision on this. It is hoped that our young people will participate in events in their local area.

If you believe that this information does not comply with your request, you do have the right to request us to review it. Your request should be made within 40 working days of receipt of this letter and we will reply within 20 working days of receipt. If the information supplied is unchanged following a review and you remain unsatisfied with this, you then have the right to make a formal complaint to the Scottish Information Commissioner.

If you require a review of this decision please write to Dr Kevin Woods, Director-General, Health Directorate, Floor 1E.10, St Andrews House, Regent Road, Edinburgh EH1 3DG. The review will be undertaken by staff not involved in the original decision.

Yours sincerely,

Joyce McVarrie
