Dear Mark Jennings
Thank you for your request for information under the Freedom of Information Act. As your
request for information falls within the Agency’s day to day business, your request is
subsequently being treated as ‘Business as Usual’.
You have specifically referred to your letter of 3 May and state that you have had no
response. I wish to make clear that our letter dated 10 September was in response to all of
your previous correspondence, which had been forwarded to the Agency. I apologise, if this
was not made clear.
As you are aware from our previous letters, you must register and licence any vehicles kept
by you. Similarly you must seek and keep up to date a driving licence issued by this agency
if you intend to drive a motor vehicle on the public road. There are penalties provided for in
statute law for breach of these obligations.
Registration numbers are not items of property in their own right, so it is not possible to
acquire legal title to them. They are assigned to, and may be withdrawn from vehicles, rather
than keepers, by the Secretary of State, as part of the basic registration and licensing process
required by law. The main purpose of registration numbers is to make vehicles readily
identifiable for road traffic enforcement and road safety purposes.
As stated, in our correspondence dated 10 September, you may want to obtain independent
legal advice so that you properly understand the fit between your view of your obligations
and the application of statute law requirements to you. We will not enter into any further
discussion on the matter.
