FREEDOM OF INFORMATION REQUEST
I write with reference to your request for information dated 9th May 2009. You asked for the following information:-
i) The official documents or guidance given by Sefton Council to Sefton Council Community School Governing Bodies informing them of their responsibilities to monitor their staff as stated in your letter of 8th May 2009.
The School Teachers pay and Conditions Document 2008 (STPCD), Section 3, page 192 reminds Governing Bodies that they should be aware of the Working Time Regulations 1998 and gives the link to the appropriate website www.opsi.gov.uk/si/si1998/19981833.htm. I have not provided a copy of the STPCD with this letter, as the document is over 200 pages long and information reasonably accessible to an applicant by other means, is an exemption under Section 21 (1) of the Freedom of Information Act 2000. You can access a copy of the STPCD on the Teachernet website at http://www.teachernet.gov.uk/docbank/index.cfm?id=12833 .
The Whole School Pay Policy is guidance for schools based on the STPCD and also refers schools to local agreements and the Green Book for support staff. The document is commended to all Governing Bodies for adoption and can be individualised by schools. I have attached a copy of this document for you.
All schools also have access to the Blue Book via the Sefton Schools Intranet. Section 7 deals with Additional Employment During Off Duty Hours. As the information is located on the Intranet, this can only be accessed from within the Sefton network. If you require a hard copy printing off please do not hesitate to contact me. I will need your postal address, in order to send the information to you.
ii) Details of how a school monitors staff working hours to ensure that they do not work more than 48 hours so as to comply with the working time directive.
The Local Authority is responsible for monitoring the contracted working hours of school staff. There is no obligation to monitor additional hours worked during employment outside the Authority, so this information is not held centrally. You would have to approach individual schools for this information.
iii) Provide a copy of the 'disclaimer form' referred to in your letter.
