Dear Mr Henderson

REVIEW OF A REQUEST UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002 (THE “ACT”)

I refer to your email of 9 May 2009 received by the Council on 11 May 2009 requesting a review as a request for information you had previously sent to the Council had not been responded to as follows:-

“This request is currently overdue a response from Glasgow Council. By law, the response had to be prompt but no later than 8 May 2009. Under the Freedom of Information Act you should have replied by now, and are breaking the law by not doing so. The information I request is for 2008 and the dates so far in 2009.”

I understand you have not received any response to your information request. Accordingly I have now conducted a review of this matter, addressing the issue of the non-response to your request.

On behalf of the Council I apologise for the lack of response to your request. You should have received a response to your request within the twenty working day time frame set down in the legislation and I apologise that you did not.

I have carried out an investigation to ascertain the reasons for the non-response to your request. The Council have conducted a thorough check of files and I can confirm that the Council do not hold a record of your original freedom of information request.

In the course of the investigation it has been confirmed that your original email request was initially quarantined and then deleted automatically by the Council's external unsolicited bulk email filter (spam filter). The Council has now put in place a process to refine the functionality of the spam filter.

I apologise for any inconvenience that this may have caused you and would ask that you resubmit your original freedom of information request in full to the Council to allow this to be actioned in accordance with the Act and Council procedures.

If you are not satisfied with the response you have received in this letter you have the right to make an application within six months of receipt of this letter for a decision by the Scottish Information Commissioner, Kinburn Castle, Doubledykes Road, St Andrews KY16 9DS.
