FREEDOM OF INFORMATION ACT 2000
I refer to your request of 3rd April 2009 concerning the alleged failure of the electronic parking brake system (EBS) installed on the current VW Passat model. In particular you asked for:-
Copies of the results/findings of a test carried out on a vehicle supplied by Volkswagen to our Vehicle Safety Branch, including details of the tests carried out.
Copies of minutes of meetings held with Volkswagen in England and Germany, and any correspondence with VW in relation to the EBS, in particular meeting minutes/notes from a meeting with VW held in Germany on 25th March 2009.
Copies of any correspondence/technical literature received from the manufacturer of the EBS supplied to VW.
Information is being withheld in accordance with the exemption in Section 44 of the Freedom of Information Act 2000, which I reproduce below for your information.
Section 44
Information is exempt information if its disclosure (otherwise than under this Act) by the public authority holding it -
is prohibited by or under any enactment
is incompatible with any Community obligation
would constitute or be punishable as a contempt of court.
The enactment in this instance is Part 9 of the Enterprise Act 2002.
