FREEDOM OF INFORMATION (SCOTLAND) ACT 2002
REQUEST FOR INFORMATION
I refer to your request for information from the Scottish Crime and Drug Enforcement Agency
(SCDEA) as follows,
‘Can you tell me the number of job vacancies currently advertised within your department on this
day 1/04/09 broken down into those advertised internally and those advertised externally?”
By way of explanation, the Freedom of Information Act (Scotland) 2002 (FOISA) places a
requirement on “public authorities” to answer requests received from members of the public.
“Public authorities” for the purpose of the Act are listed within Schedule 1. Whereas police forces
are listed within this Schedule, the SCDEA is not.
On 1 April 2007, as a result of the Police, Public Order and Criminal Justice (Scotland) Act 2006,
the SCDEA became a statutory body, maintained by the Scottish Police Services Authority (SPSA).
The 2006 Act includes the SPSA as a ‘public authority’ under the amendment to Schedule 1 of
FOISA, but only in relation to those police support services it provides.
The SCDEA is not a
police support service and is therefore not included in Schedule 1. In other words, the
SCDEA is not covered by the provisions of FOISA and is under no obligation as an
organisation to respond to FOIA requests.

However, the Agency aims to make non-operational information available on its website, which
will include documents such as the Annual Report and the Annual Plan. Also, we may respond to
reasonable requests for information,
although not under the provisions of FOISA legislation, if we
hold such information. However, requests for information about particular activities of the SCDEA
will be refused.
In this instance the Agency is willing to supply the following information,
although not under the
