Dear Mr Vinney,

I am writing regarding your recent request for information to Somerset
County Council. Although you made the request under the Freedom of
Information Act, your enquiry is substantially in connection with
environmental information and therefore falls under the Environmental
Information Regulations, (EIR) (2004). These regulations are very similar
in effect to the Freedom of Information Act, but have slightly different
conditions. More information on them is available at the Information
Commissioner's website [1]www.ico.gov.uk

Your request made to the Council concerned: `The National Trust recently
hired and paid a contractor, for a stage 3 safety audit. Can I have a copy
of the report that was sent to the council via the Trust.'

I can confirm that we have received a draft of the Stage 3 Road Safety
Audit. We will be responding to the author shortly with comments. Once we
are happy with the contents of this report the author will issue the
report to his Client who in turn will ask his designer to formulate a
response which will be duly submitted for our consideration. We then go
through an iterative process to reach agreement on what actions, if any,
are necessary to address the findings of the audit.

We can only consider release of the findings of the Road Safety Audit
report once we have reached agreement on the outcomes.

Under the Environmental Information Regulations (and the Freedom of
Information Act), we have the right to withhold information if an
exception applies. In this case, we believe that exceptions apply

* Regulation 12(4) (e) which relates to unfinished documents or
incomplete data.
* Regulation 12(5)(e). This provides that the Council may refuse to
disclose the information to the extent that its disclosure would
adversely affect the confidentiality of commercial or industrial
information where such confidentiality is provided by law to protect a
legitimate economic interest.

The application of these exceptions is subject to the compulsory
application of the public interest test. We have considered the balance of
public interest. Whilst it is in the public interest for people to
understand matters which are likely to affect them, the Council is in the
process of reaching an agreement on the eventual outcome and we do not
believe that it would be in the public interest to release the draft
report at this stage of the process.

We are talking about a safety audit carried out in respect of a public highway are we not ? Some of the affected residents met with the auditor beforehand and were told that his only concern was the safety aspects of the public highway and not the private part of the road so why would there be any need to withhold the information on the grounds that commercial interest would be put at risk -- exactly whose commercial interest would that be then?

I suggest that the information requested is for work upon the
public highway,and is therefore in the public domain and not
subject to Regulation 12(5)(e).
Can you also explain why a length of concrete and tarmac road would
be commercially sensitive and how its economic interest would be
compromised by requesting a stage 3 safety audit report.

Dear EnvironmentPSO,
You have stated, regarding Regulation 12(4) (e):

‘We can only consider release of the findings of the Road Safety
Audit report once we have reached agreement on the outcomes.’
Surely a democratic approach would be to consult all affected
parties, and then formulate a response.

You also state:
‘We then go through an iterative process to reach agreement on what
actions, if any, are necessary to address the findings of the
audit.’
Would this be the iterative process that was undertaken in the
second Audit report by which procedure the road was narrowed by
some 26 ins? In so doing, contradicting your own recommendation
1.1.5.

Dear Mr Vinney,

I am writing in reply to your email of 23rd September. I apologise that I
 did not acknowledge your email.

On 26th July you made a request  which we considered under the
Environmental Information Regulations and replied to on the 9th August.

 ‘The National Trust recently hired and paid a contractor, for a stage 3
safety audit. Can I have a copy of the report that was sent to the council
via the Trust.’

In my  response to you on the 9th August we did not release the
information because we believed that exceptions applied.

However, as the outcomes from the Stage 3 Road Safety Audit have now been
agreed we no longer consider that these exception apply. I have attached a
copy of the Stage 3 Road Safety Audit, the Designer’s Exception Response
and the response from the Highway Authority which will give a full trail
of the agreed outcomes from this audit exercise. I have edited the
documents to remove a small amount of personal information where we
believe it is exempt from disclosure under Regulation 13 - Personal
Information about third parties where release would contravene the Data
Protection Act.
